From everyone at Smored LLC, thank you for using our software! We built SmoredBoard to enhance your experience and give you the best soundboard we can. 


 

Definitions

When we say "Company", "we", "our", or "us" in this document, we are referring to Smored LLC

When we say "Services", we mean our website (smoredboard.com) and any product created and maintained by Smored LLC, including the SmoredBoard soundboard software, SmoredBoard Pro, and their associated tools.

When we say "You" or "your", we mean the people or organizations that own an account with or use any of our Services.

 

Acceptance of Terms

By downloading, installing, accessing, or using SmoredBoard or creating an account, you agree to these Terms of Use (“Terms”). We may update these Terms from time to time. If we make significant changes, we will update the date at the top of this page and do our best to notify account holders. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.
 

Account Terms

  • You are responsible for maintaining the security of your account and password. You are also responsible for all activity that occurs under your account.

  • You may not share your account or login credentials with any other person. If account sharing is detected, we may suspend or terminate access without notice.

  • You must use accurate information when creating an account. Accounts created with false, misleading, or impersonated information may be suspended or terminated.

  • You may not use the Services for any unlawful purposes or violate any laws while using our Services.

  • You are responsible for all content you post and any activity that occurs under your account.

  • Accounts may not be registered or accessed by bots or other automated methods.

  • You meet the age requirements outlined in the “Minors” section of these Terms.

 

SmoredBoard Terms

SmoredBoard is free to use for both personal and commercial purposes. You may use the software in livestreams, content creation, business settings, and other commercial contexts.


However, by using the Services, you agree to the following:

  • You meet the age requirements outlined in the “Minors” section of these Terms.

  • You will not modify, copy, distribute, sublicense, or publicly display the software without our prior written permission.

  • You will not use the software for illegal, abusive, or harmful purposes

  • You will not attempt to bypass any licensing or Pro restrictions

  • You will not reverse engineer, decompile, disassemble, or otherwise tamper with the Services (see the “Reverse Engineering and Tampering” section below).

  • You are solely responsible for your use of the integrated browser, including any content accessed or downloaded through it. Please refer to the “Integrated Browser & Download Disclaimer” section below for full details.

  • You are also responsible for any content you include or share through SmoredBoard Profiles. For more information, see the “SmoredBoard Profiles & Sharing” section below.

SmoredBoard may automatically update itself to improve features, fix bugs, or enforce licensing. By using the software, you consent to receive such updates.

We may update, disable, suspend, or remove access to the free version at any time, including in cases of misuse or violation of these Terms.

We may suspend or terminate access to SmoredBoard or any Services, in our sole discretion, with or without notice, including for actual or suspected violations of these Terms.

SmoredBoard Pro Terms

SmoredBoard Pro is a premium subscription-based service that provides access to additional features and tools. Payments are processed by Stripe, our PCI DSS–compliant payment processor. Smored LLC does not store or have access to full payment card details. By subscribing to SmoredBoard Pro, you agree to the following:

 

1. Subscription Plans:

  • SmoredBoard Pro is available through monthly, annual, and lifetime subscriptions, with current pricing listed on our website.

  • You are responsible for selecting a plan that meets your needs. Plan details are available on our website.

2. Payments and Renewals:

  • All subscription payments are processed securely through Stripe.

    • Subscriptions automatically renew at the end of the billing period unless canceled before the renewal date.

    • If a payment fails or cannot be processed, your account may be suspended or downgraded to the free version until the issue is resolved.

    • We reserve the right to modify the pricing of SmoredBoard Pro subscriptions at any time.

    • If we change the price of your plan, you will be notified at least 14 days in advance.

    • Continued use of SmoredBoard Pro after the effective date of the price change constitutes your acceptance of the new pricing.

    • Renewals made after the effective date of the price change will automatically reflect the updated pricing.

3. Free Trial:

  • We may offer a free trial of SmoredBoard Pro that requires you to provide payment information upfront. Trial length and terms are shown at the time of sign-up.

  • If you do not cancel before the trial ends, your card will be charged. Refunds for trials that automatically convert to paid plans are subject to our refund policy.

4. Refund Policy:

  • Refunds may be available for SmoredBoard Pro purchases, including subscriptions and lifetime licenses, if requested within 48 hours of purchase or renewal, except as otherwise required by applicable law. To request a refund, please contact our support team at support@smoredboard.com.

  • Refunds are not available for partially used subscription periods beyond 48 hours, except where required by applicable law.

  • Once a refund is issued, access to Pro features will be revoked immediately. We may deny repeated or abusive refund requests from the same user or account.

5. Access and Usage:

  • SmoredBoard Pro features are licensed to the account holder and may not be shared, resold, or transferred.

  • Access to Pro features is subject to compliance with these Terms.

6. Modifications:

  • SmoredBoard reserves the right to modify or discontinue Pro features at any time, with or without notice.

7. Termination:

  • If your subscription is terminated for any reason, access to Pro features will end at the conclusion of your current billing period.

 

Minors

You must be at least 13 years old to use our Services, except where a higher minimum digital consent age is required by your country’s laws. For example, in many parts of Europe, the minimum age is 16.

If you are under the minimum age in your country, you may not use our Services.

If you are old enough to use our Services in your region but not yet the legal age of majority, you must use our Services with the consent and supervision of a parent or legal guardian. They must review and agree to these Terms of Use and our Privacy Policy with you.

If we become aware that a child under the required minimum age has provided personal data without appropriate consent, we will take steps to delete that information.

Acceptable Use

You agree not to misuse the Services. Prohibited uses include, but are not limited to: harassing or threatening others; attempting to interfere with or disrupt the operation of the software or website; using automated tools (e.g., bots or scrapers) to access the Services; attempting unauthorized access to systems or data; and using any of our Services in a way that violates applicable law or infringes the rights of others.


 

Uptime, Security, and Privacy

  • Your use of the Services is at your own risk. The Services are provided on an “as is” and “as available” basis without any warranties. To the fullest extent permitted by law, we disclaim all liability for consequential, indirect, or special damages arising from your use of the Services. In no event shall the Company's total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the Services during the twelve (12) months preceding the event giving rise to such liability.

  • We take the security of your data seriously and implement reasonable and appropriate technical and organizational measures to protect it. However, no method of transmission or storage is completely secure. If you discover a security vulnerability, please report it immediately to security@smoredboard.com.

  • For details on how we handle personal data, please refer to our Privacy Policy available on our website.


 

Copyright and Content Ownership

  • You retain ownership of content you submit to the Services, including any sounds you upload. Except for the license granted below, we do not claim ownership of your content.

  • The Company owns all right, title, and interest in and to the Services and all related intellectual property. See “Reverse Engineering and Tampering” below.


 

Reverse Engineering and Tampering

You may not decompile, reverse engineer, disassemble, modify, or otherwise attempt to access or alter the source code, underlying algorithms, or any part of SmoredBoard, SmoredBoard Pro, or any associated services, except where explicitly permitted by us in writing or as allowed by applicable law. Where applicable law permits reverse engineering for specific lawful purposes (such as interoperability or error correction), such activities are permitted only to the extent required by law and must be notified to security@smoredboard.com in advance.

This includes but is not limited to:

  • Bypassing licensing or subscription restrictions
     

  • Modifying the application to remove branding, Pro limitations, or telemetry
     

  • Creating derivative works based on SmoredBoard
     

  • Using the software for analysis with the intent to replicate its functionality
     

Violations may result in account suspension, revocation of licenses, civil liability, DMCA takedowns, and/or criminal prosecution under applicable law.


 

Integrated Browser & Download Disclaimer

SmoredBoard includes an integrated browser designed to help you find and download sound files more easily.

 

By using this browser, you acknowledge the following:

 

  • You are solely responsible for any content you choose to download or use.

 

  • Smored LLC is not liable for any issues, damages, or legal consequences resulting from downloaded content, including but not limited to:

    • Copyright infringement

    • Malicious files or viruses

    • Low-quality or inappropriate content

 

Use at your own risk. Always double-check the source of any file before downloading.

 

SmoredBoard provides the tool; your use of it is solely your responsibility.


 

SmoredBoard Profiles & Sharing

SmoredBoard lets users create and share SmoredBoard Profiles (.smored files), which may include embedded audio and images or reference external content (such as via the Voicy API), depending on how the profile was created.

We do not review, verify, or moderate any SmoredBoard Profiles shared by users.

By creating, importing, exporting, or sharing SmoredBoard Profiles, you acknowledge that:

  • You are fully responsible for any content your profiles include or link to.

  • You should only include content you have the right to use or share, particularly if distributing it publicly.

  • Smored LLC does not host or control externally linked media (including content accessed via the Voicy API) and is not responsible for its availability, legality, accuracy, or security.

  • Smored LLC is not liable for any issues that result from the use or sharing of SmoredBoard Profiles.

We encourage users to be thoughtful when creating and sharing SmoredBoard Profiles, especially when those profiles include copyrighted content and are shared publicly. Exporting, importing, and sharing profiles is entirely at your own risk.


 

Third-Party Integration

The only official third-party integration currently available is with the Stream Deck. We do not offer an open API for public use.

SmoredBoard includes a built-in Voicy profile builder that helps users browse the Voicy website and add sounds to build SmoredBoard Profiles. This functionality is provided with permission from Voicy, but Smored LLC and Voicy operate independently and are not joint partners.

Smored LLC does not host or control any content provided by Voicy. All Voicy content is subject to Voicy’s own terms of service and policies.

We are not responsible for the behavior, reliability, legality, or security of any third-party tools, services, or hardware that interact with SmoredBoard, including Voicy and any unofficial or community-made integrations.

Use of any third-party integrations is entirely at your own risk. Smored LLC makes no guarantees about their performance, compatibility, or legal compliance.


 

Disclaimer of Warranties

SmoredBoard and all related Services are provided on an “as is” and “as available” basis without warranties of any kind. We do not make any guarantees, express, implied, statutory, or otherwise about the reliability, security, compatibility, or accuracy of the services.

To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from the course of dealing or usage of trade.

We do not warrant that SmoredBoard will be uninterrupted, error-free, secure, or that any bugs or defects will be corrected. You use the software entirely at your own risk.


 

Liability

To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including lost profits, lost data, or loss of goodwill, arising from the use of, or inability to use, our Services.

 

If, despite the foregoing, we are found to be liable to you for any damages, our total liability will not exceed the amount you paid to us in the 12 months prior to the event giving rise to the claim, or fifty dollars ($50), whichever is greater.

 

You use our Services at your own risk.

 

Governing Law and Jurisdiction 

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any legal actions or disputes shall be resolved exclusively in the courts located in Florida.

 

Smored LLC will not be responsible for any delay or failure to perform due to events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, government actions, utility or telecommunications failures, or internet outages.


 

Dispute Resolution and Class Action Waiver

Before taking formal action, we encourage you to reach out to us at support@smoredboard.com with any concerns. We care about our users and will do our best to resolve issues in good faith.

 

Any dispute or claim arising out of or relating to these Terms or your use of the Services will be resolved on an individual basis. You agree not to bring or participate in any class action, collective action, or representative proceeding against Smored LLC. If you are a consumer in the European Union, this provision does not affect your right to bring disputes before your local courts or consumer protection authorities as permitted by applicable law.

 

To the extent permitted by law, you waive any right to a jury trial in any legal proceeding related to these Terms or your use of the Services.

 

Survival

Any sections of these Terms that by their nature should survive termination will remain in effect even after you stop using our Services. This includes, but is not limited to: Reverse Engineering and Tampering, Copyright, Liability, Governing Law, Dispute Resolution and Class Action Waiver, Security Vulnerability Reporting, and this Survival clause.
