The privacy of your data, and it is your data, not ours! is a big deal to us. In this policy, we lay out: what data we collect and why; how your data is handled; and your rights with respect to your data. 

 

We do not sell your personal information and have not done so in the preceding 12 months.

 

This policy applies to all products built and maintained by Smored LLC, including SmoredBoard, SmoredBoard Pro, and all our websites (smoredboard.com, help.smoredboard.com). This policy does not apply to third-party websites or services that we do not control.

 

What We Collect And Why

We collect only the data necessary to provide, secure, and improve SmoredBoard. Here's a breakdown of the types of information we collect and why we collect them:

 

  • Account Information: If you make a SmoredBoard account we collect your email address for authentication, tracking subscription status, and informing you of changes to your account or other essential information. 

    • If you opt-in to marketing emails we will also use that email to send you promotional details. You can unsubscribe from promotional emails at any time by clicking the link in any message or adjusting your email preferences.

    • If you sign up using a third-party authentication provider (like Google or Microsoft), we receive basic account information from that provider, such as your name and email address. We do not access or store your password or any other personal data from your external accounts.

 

  • Payment Information: We use Stripe to process payments for SmoredBoard Pro. When you make a purchase, your payment details (such as your credit card number or billing address) are securely collected and handled by Stripe. We do not have access to or store your full payment information on our servers.

    • We only receive limited details from Stripe, such as your name, email address, billing country, and the last four digits of your card, solely for the purposes of verifying your purchase, providing customer support, handling refunds, and complying with legal obligations (like tax reporting).

 

  • Device and Location Data: When you visit our website, we collect limited technical information, including your general location (e.g., country or region based on your IP address), browser type, operating system, and device type. This helps us understand where users are accessing our services from, optimize performance, monitor for abuse, and improve the overall experience.

    • We also collect the same data when you log in to a SmoredBoard account. This information is used solely for fraud prevention, account protection, and internal abuse monitoring.

  • Installer, Update, and Uninstall Logging: When you download the SmoredBoard installer either the first time or through the auto-updater, our servers log your IP address, timestamp, and the file or URL accessed. This allows us to estimate unique installs/updates and monitor download activity.

    • If you uninstall SmoredBoard, we log your IP address, timestamp, and operating system version information. This allows us to estimate unique uninstalls and monitor higher uninstall rates on certain OS’s allowing us to easily identify issues.

    • This data is anonymous and while not directly linked to individual users, may be technically linkable to IP addresses or device identifiers. We process this data based on our legitimate interest in monitoring software performance and security. We may use aggregated statistics (such as total installs) for internal analytics or performance monitoring. 

  • Usage Analytics: When using SmoredBoard, we collect usage analytics data through a randomly generated session identifier created each time you launch the application. While this identifier is pseudonymous, we treat it as personal data under applicable privacy laws.

    • We process this data based on:

      • Consent (for EU/UK users)

      • Legitimate interest (for other users)

    • This data helps us improve SmoredBoard's features and performance.

    • You can opt out of these analytics at any time via the Customization page in SmoredBoard’s settings. When opting out, a final anonymous “opt-out” event is sent for internal tracking purposes.

  • Error Reporting: If a critical error occurs, you will have the option to review and choose whether to submit the error, even if analytics are turned off. You may also include a short note describing what you were doing when the issue occurred. 

    • This information is sent anonymously using the same system as usage analytics. Errors contain no personal information and cannot be traced back to any user.

Sensitive Personal Information

We do not collect or process sensitive personal information as defined by the CPRA (such as Social Security numbers, precise geolocation, or biometric data).

 

Payment Security

All payment processing is handled by Stripe, a PCI DSS compliant provider. We never store, process, or transmit full payment card details.

Other U.S. State Privacy Rights 

Residents of Colorado, Connecticut, Utah, Virginia, and Texas may have privacy rights similar to those provided under the CPRA. We honor these rights as required by applicable law.

How We Share Information

We do not sell or share (as defined under the CPRA and other US state privacy laws) your personal information with third parties for cross-context behavioral advertising. We only share limited data with trusted third-party service providers ("processors" under GDPR) when necessary to operate SmoredBoard or support you as a user. Each provider has signed appropriate Data Processing Agreements that ensure your data's protection.

 

We share information with third-party service providers that act on our behalf to deliver the Services, including:

  • Microsoft Azure, for secure account authentication.

  • Stripe, to process payments and manage SmoredBoard Pro subscriptions.

  • Mailchimp, to send optional marketing emails (only if you opt in). You can unsubscribe at any time via the link in those emails.

  • PostHog, to collect usage analytics that help us improve SmoredBoard. We configure PostHog to avoid collecting directly identifiable data and honor your analytics opt-out.

We may add or change service providers in the future. Any such provider will be permitted to process your information only in accordance with our instructions, this Privacy Policy, and applicable laws.

In some cases, we may share aggregated, anonymized usage metrics (e.g. total active users, feature popularity) and anonymized error/crash logs with select third parties, such as analytics consultants, development partners, error-monitoring services, and machine-learning platforms that assist us in analyzing and improving SmoredBoard. This information is fully anonymized, can’t be linked back to any individual user, and contains no sensitive data.

We may also disclose your information if required to:

  • Comply with applicable laws, lawful law enforcement requests, regulatory inquiries, or court orders

  • Enforce our Terms of Use

  • Protect the rights, safety, or property of SmoredBoard, our users, or the public
     

All third parties we work with are contractually bound through Data Processing Agreements to protect your data and use it only for the specific services they provide on our behalf. For transfers of EU/UK personal data to the US or other countries without adequate protection levels, we rely on Standard Contractual Clauses (SCCs) and appropriate supplementary measures as required by GDPR.

Data Retention

We retain different categories of personal data for specific periods:

- Account information: Until account closure + 1 year

- Payment information: Until account closure + 7 years (for tax/legal compliance)

- Marketing preferences: Until consent withdrawal + 30 days

 

These retention periods may be extended if required by law or shortened upon your valid deletion request.

 

To delete your account or personal information, please contact us at support@smoredboard.com. We will execute your deletion request in accordance with applicable data protection laws.

 

We may retain aggregated and de-identified data, such as usage trends, crash statistics, logs, or active user counts, even after associated personal data is deleted. This information cannot be linked back to any individual user, which is why we’re unable to delete it on a per-user basis.

Your Rights & Choices

Depending on where you live, you may have certain rights under data protection laws such as the General Data Protection Regulation (GDPR) in the EU/EEA, the California Privacy Rights Act (CPRA), and similar laws in Colorado, Connecticut, Utah, Virginia, and Texas. Regardless of your location, we aim to honor the following rights for all users:

 

Your Rights:

  • Access

    • You can request to know what personal information we hold about you.

  • Correction

    • You can request that we correct or update inaccurate or incomplete information (like a misspelled email address). To protect your account, we may ask you to provide proof that you own the original email or account before making any changes.

  • Deletion (Right to be forgotten)

    • You can request deletion of your personal information and account at any time by emailing support@smoredboard.com. We will handle the request in accordance with applicable laws.

  • Portability

    • You can request a copy of your personal data (such as your email address or name) in a structured, machine-readable format.

  • Withdraw Consent

    • If you’ve opted in to receive marketing emails or to share analytics, you can withdraw that consent at any time via your account settings or by contacting us.

  • Object to Processing

    • You can object to certain types of processing, such as the collection of anonymous usage analytics, by opting out in the SmoredBoard’s settings

 

How To Exercise These Rights:

To exercise any of these rights, please contact us at support@smoredboard.com. We may ask for verification to protect your account from unauthorized access.

We’ll respond to requests within a reasonable timeframe in accordance with applicable laws (typically within 30–45 days, which may be extended where permitted).

 

Data Security

We take data security seriously and implement industry-standard safeguards to protect the information we collect and process. These safeguards include secure communication protocols, controlled access, encryption where appropriate, and ongoing monitoring and maintenance. For payment processing, we exclusively use Stripe, a PCI DSS-compliant payment processor. We never store, process, or transmit full payment card details. However, no method of electronic transmission or storage is ever 100% secure. While we do our best to protect your data, we cannot guarantee absolute security.

If we discover a data breach that affects your personal information, we will notify relevant supervisory authorities within 72 hours and affected users without undue delay, as required by GDPR and other applicable laws. We maintain a dedicated security incident response plan and will provide specific guidance on steps you should take to protect yourself in the event of a breach.

By using SmoredBoard and our Services, you acknowledge inherent risks associated with transmitting data online and agree to use SmoredBoard and our Services at your own discretion and risk.

 

Integrated Browser

SmoredBoard includes an embedded browser for accessing external content. While we don't monitor your browsing activity, third-party websites accessed through this browser may:

  • Set cookies or similar tracking technologies

  • Collect personal data according to their own privacy policies

  • Process your data in countries outside your jurisdiction

  • Use your data for their own purposes including advertising

 

We strongly recommend:

  • Reviewing each site's privacy policy before use

  • Being cautious about entering personal information

  • Using privacy-protective browser settings

  • Understanding that our Privacy Policy doesn't cover third-party practices

The embedded browser follows your system's security settings and certificates.

Location of Site and Data

SmoredBoard is operated from the United States. If you access our services from outside the U.S., please note that your personal data may be transferred to, stored in, and processed in the United States or other countries where our trusted service providers operate.

Under EU/UK GDPR, transfers of personal data to countries outside the EU/EEA/UK (e.g. the U.S.) are permitted only when:

  • The destination country has received an adequacy decision from the European Commission, or

  • Appropriate safeguards are in place, such as Standard Contractual Clauses (SCCs), Binding Corporate Rules (BCRs), or other approved mechanisms.
     

We rely on Standard Contractual Clauses and other approved safeguards provided by our service providers (e.g. Microsoft, Stripe) to legally transfer and protect your personal data.

By using SmoredBoard from outside the U.S., you acknowledge and consent to these international data transfers under the terms of this Privacy Policy and applicable laws.

 

Minors

SmoredBoard and our Services are not intended for use by children under the age of 13, or the minimum digital consent age required by your country’s laws, whichever is higher. If you are under the applicable age in your country, please do not use our Services or provide any personal information.

If you are 13 or older but under the age of majority in your jurisdiction, you may only use our Services with the consent and supervision of a parent or legal guardian. They must review and agree to this Privacy Policy and our Terms of Use with you, and they are responsible for your use of our Services.

We do not knowingly collect personal information from anyone under the applicable minimum age. If we become aware that we’ve collected data from someone under that age without proper authorization, we will delete it as quickly as possible. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes to our practices, technologies, or legal requirements. If we make significant changes, we will update the “Last updated” date at the top of this page and, if appropriate, notify you through the SmoredBoard application when an update occurs or via email (if you’ve provided one).

We encourage you to review this Privacy Policy periodically to stay informed about how we protect your information.
